This website is operated by AS by Akansha Sethi Ltd. Throughout the site, the terms “we”, “us” and “our” refer to AS by Akansha Sethi. AS by Akansha Sethi offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms and conditions stated here.

No person under the age of 18 years may purchase Goods. If you are under 18, please confer with an adult to make your purchase.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time. 

Our Contract with you

Before your order can be accepted we must receive payment in whole for the price of the goods that you order.

Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form.

Our acceptance of your order brings into existence a legally binding contract between us, concluded in London, England and the language of the contract is English.

To order goods and to transact through this site, you must be entitled to enter into legally binding contracts. Individuals unable to perform legally binding contracts are prohibited from ordering goods using the Sites.

If you do not qualify do not use this site, AS BY AKANSHA SETHI holds the right to refuse to process a transaction or order for any reason at any time.

If any products we deliver to you are damaged, or of an incorrect quantity or not what you ordered, we shall have no liability to you unless you notify us by e-mail of the problem within 5 working days of the delivery of the products. If you notify us of a problem, our obligation will be to either,

a) To make good any shortage or no-delivery;

b) To replace any goods that are damaged or defective;

c) To refund you the amount paid by you for the goods in question in whatever way we choose.

There may, on occasion, be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the is inaccurate at any time without prior notice.

The service and all products and services delivered to you through the service are provided without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law.

The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

Events Beyond Our Control

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Eligibility to purchase

The purchase of products through the Sites is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law.

In order to make purchases through the Site, you will be requested to provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated.

Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet AS BY AKANSHA SETHI’s terms of eligibility, who have been issued a valid credit card by a bank acceptable to AS BY AKANSHA SETHI, whose applications are acceptable to AS BY AKANSHA SETHI and who have authorised AS BY AKANSHA SETHI to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. AS BY AKANSHA SETHI reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

Pricing and payment

The prices payable for goods that you order are as set out on our website. All of our prices are in UK Pounds Sterling. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.

If you are buying from outside the UK, you will also incur any duties levied by the jurisdiction to which you have specified delivery. Payments can be made by Visa, MasterCard, American Express as well as PayPal and credit cards supported by PayPal.

Payments will be debited and cleared from your account upon receipt of your order by AS BY AKANSHA SETHI. If the issuer of your payment card or method refuses to authorise payment to AS BY AKANSHA SETHI, we will not be liable for any delay or non-delivery.

Your satisfaction guarantee and rights to cancel your contract

AS BY AKANSHA SETHI guarantees your total satisfaction with our products and services. In the unlikely event that you are unhappy with your purchase, you can return the items to us within 7 days of receipt of order and we will be happy to offer you either an exchange or full refund minus any postage costs, providing the goods are returned in perfect condition as follows:

a) You have not worn or damaged the jewellery.

b) You have not removed the security tag from the jewellery item.

c) You have contacted us within 7 working days of receiving your goods at

 d) You return your goods within 7 days of receiving your RN (Return Number).

Bespoke and engraved items are Special Orders, which means that the item will be made or customised especially for you; because of this, these pieces of jewellery cannot be exchanged or returned under any circumstances. 

For reasons of hygiene, we are unable to offer exchanges or refunds on earrings.

Returns are to be received by AS BY AKANSHA SETHI within 7 days after receiving a the RN. Returns outside this timeframe may be accepted at the discretion of AS BY AKANSHA SETHI and may only be refunded as store credit. 

Exchanges

If you have requested an exchange we will only be able to ship your exchanged goods once we have received the returned item(s). You will be charged for any additional cost and any additional shipping, taxes and import duties.

Copyrights, trademarks & commercial use

We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in: text, graphics, logos, icons, images, digital downloads, data, and software.

We also claim copyright in the designs and compilation of all Content of Our Website. Title and ownership rights will remain the sole property of us and we will strongly protect those rights in all countries and territories.

Except as set out below, you may not copy, modify, publish, transmit, transfer, sell, reproduce, derive works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part.

You may not use our name, logos, trademarks or any other Content on any website of yours or that of any other person.

Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not electronically store a significant portion of any Content.

In certain circumstances and only if published credit to AS BY AKANSHA SETHI (and AS BY AKANSHA SETHIs relevant social handle) is given, you may share promotional imagery found on www.akanshsethi.com through social and other channels. You may not adapt, alter or create a derivative work from any www.akanshasethi.com content or imagery prior to sharing, without prior written permission of AS BY AKANSHA SETHI.

Invalidity

We will communicate with you by email and you agree that email communications are contractually binding in the same way as signed and dated paper sent by post.

Where we provide goods or services without specific charge to you, then it is deemed to be provided free of charge, and accordingly, there is no contractual nor other obligation upon us in respect of those goods or service nor shall we confer any benefit or obligation on any third party.

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

If any part of these terms and conditions is unenforceable, unlawful or for any reason unenforceable, including any provision in which we exclude our liability to you, the enforceability of any other part of these conditions will not be affected.
